In 2017 Massachusetts' highest court ruled in Lunn v. Commonwealth that state officers may not hold someone past release solely on a federal civil immigration detainer — and then-AG Healey called it 'a victory for the rule of law ... as my office argued in this case'.
Lunn was the first statewide high-court ruling in the nation on the question.
Executive Order 650 (January 29, 2026) bars new 287(g) agreements with ICE absent a certified public-safety need and bars civil ICE arrests in nonpublic areas of state facilities without a judicial warrant.
It also bars use of state property as ICE staging or processing areas.
A state plan to place migrant families at the Yarmouth Resort on Route 28 was halted in August 2023 over code-enforcement problems before any families moved in.
Separately, Yarmouth Harborside Suites housed six migrant families from September 2023 to April 2024.
State records obtained by the Boston Globe showed more than 1,000 serious incidents at Massachusetts emergency family shelters over a 20-month period, including more than 670 in 2024.
