A Southampton couple denied a foster-care license by the state Department of Children and Families over their religious views on gender and sexuality is suing in federal court (now Burke v. Mahaniah).

DCF amended the policy in December 2025 but continues to defend the 2023 denial; both sides filed summary-judgment motions March 13, 2026. No ruling yet — the case is pending. This concerns fostering, not adoption.
